Under his FBI Employment Agreement, Comey would forfeit any profits from a leak-related book deal.
Following the Comey Hearing last week, reports began circulating that publishers were lining up to offer disgraced former Director of the FBI, James Comey, a $10 million tell-all book deal.1
However, if the book contained anything leak-related, then under Comey's FBI Employment Agreement the profits would go to the United States.
The three key points from the FBI Employment Agreement in regard to profits arising from leaking are:
* Agreement not to reveal any information acquired by virtue of official employment (section 3).
* If the agreement is violated, any profits arising from leaking will be irrevocably assigned to the United States (section 7).
* The agreement applies even after Comey was fired (section 10).
So any profits from a book deal could potentially be assigned to the United States.
However, the Employment Agreement does specify 'profits arising from any unauthorized publication or disclosure'. With specific regard to the Employment Agreement, the 'disgorging of any profits' would therefore only apply if a book or books contained anything leak-related.
